Making a Will in South Australia
Last updated 25 October 2026
You can make a valid Will online in South Australia in about 15 to 20 minutes. RapidWills tailors your Will to the Succession Act 2023 (SA), and gives you step-by-step signing instructions for South Australia.
What South Australian law says
- Since 1 January 2025, Wills, intestacy and family provision claims in South Australia have been governed by the Succession Act 2023, which replaced the Wills Act 1936 and other older laws. If your Will was made under the old rules, now is a good time to review it.
- Getting married revokes an existing Will unless the Will expressly says it is made in contemplation of that marriage. Engaged couples should make sure their Will includes this wording.
- Divorce generally revokes gifts to your former spouse and their appointment as executor.
- Certain people can apply to the court if they believe your Will did not adequately provide for them.
Signing your Will in South Australia
Print your Will and sign it in ink in front of two adult witnesses who are both present at the same time. Although a gift to a witness is not void in South Australia, it is best practice to choose witnesses who are not Beneficiaries. RapidWills only recommends wet-ink signing.
What happens without a Will in South Australia
If you die without a Will, your Estate is divided under the Succession Act 2023, usually to your partner and children in set shares, with no regard to your personal wishes.
