Making a Will in the ACT

Last updated 25 October 2026

You can make a valid Will online in the Australian Capital Territory in about 15 to 20 minutes. RapidWills tailors your Will to the Wills Act 1968 (ACT), and gives you step-by-step signing instructions for the ACT.

What ACT law says

  • Wills in the ACT are governed by the Wills Act 1968, and intestacy by the Administration and Probate Act 1929.
  • Getting married revokes an existing Will unless the Will expressly says it is made in contemplation of that marriage. Engaged couples should make sure their Will includes this wording.
  • Divorce generally revokes gifts to your former spouse and their appointment as executor.
  • Certain people can apply to the court under the Family Provision Act 1969 if they believe your Will did not adequately provide for them.

Signing your Will in the ACT

Print your Will and sign it in ink in front of two adult witnesses. In the ACT, the witnesses must sign in your presence and in each other's presence, so keep all three people together from start to finish. Although a gift to a witness is not automatically void in the ACT, it is best practice to choose witnesses who are not Beneficiaries. RapidWills only recommends wet-ink signing.

What happens without a Will in the ACT

If you die without a Will, your Estate is divided under the Administration and Probate Act 1929, usually to your partner and children in set shares, with no regard to your personal wishes.
